Onside.io App Store Terms of use

1. Your Relationship with Onside.io BV
When you use Onside.io's products, software, websites, or services
(collectively referred to as the "Services"), your use is governed by a
legal agreement between you and Onside.io. "Onside.io" refers to
Onside.io BV, headquartered and registered at Keizersgracht 555, 1017 DR
Amsterdam, The Netherlands.
This document outlines the framework of that agreement and introduces
some key terms that will apply.
The Services include, but are not limited to:
- App Store Website
- iOS App
- TV Application
- Uploader Tools
- Lite Version App
- Backup Services
- App Discovery Platforms
- Discovery Launchers
Unless you have a separate written agreement with Onside.io, your use of the Services will be subject to the terms outlined here (referred to as the "General Terms").
In addition to the General Terms, specific services may have their own legal notices or additional terms, collectively referred to as the "Additional Terms." If applicable, the Additional Terms will be available within or alongside the specific Service.
Together, the General Terms and any applicable Additional Terms form a legally binding agreement between you and Onside.io, which we refer to as the "Terms."
Please review these Terms carefully. If there is any inconsistency between the Additional Terms and the General Terms, the Additional Terms shall prevail concerning that particular Service.
2. Acceptance of the Terms
To use our Services, you must first accept the Terms. If you do not
agree to these Terms, you are not permitted to access or use the
Services.
You can accept the Terms by:
- Clicking an acceptance button or checking a box when this option is presented within the user interface of a Service; or
- By simply using the Services, in which case you acknowledge and agree that your usage constitutes acceptance from that point forward.
You are not allowed to use the Services or accept the Terms if:
- You are legally prohibited from doing so under the laws of your country of residence or location, or
- You do not have the legal capacity to enter into a binding agreement with Onside.io.
- To use our Services, you must meet the minimum age requirements set by
applicable European Union laws and regulations.
- Under the General Data Protection Regulation (GDPR), if you are under the age of 16 — or a lower age if permitted by your country's laws (but never below 13) — you may only use the Services with the consent of a parent or legal guardian.
- By accessing or using the Services, you confirm that you meet the minimum age requirement applicable to your country of residence, or that you have obtained any necessary parental or guardian consent.
We recommend that you print or save a copy of these General Terms for your records.
3. Language
If Onside.io provides a translation of the Terms, this translation is
offered for your convenience only. The English version remains the
definitive version governing your relationship with us. If there is any
conflict between a translated version and the English version, the
English version will take precedence.
4. Delivery of Services by Onside.io
When you create a user account for any Service offered by Onside.io, you
automatically gain access to all other Services provided through the
Platform, using your login credentials (username and password). Certain
Services may have their own specific terms, which you must review,
accept, and comply with in order to use them
Through Onside.io, you can discover, browse, download, and purchase
applications and other digital content designed for devices operating on
the Apple system ("Apps").
The term "Apps" includes all associated materials such as content,
advertisements, services, technologies, data, in-app purchases, and
other digital resources made available within or alongside the App — even after downloading. It also covers future updates, upgrades,
patches, or new releases you may install.
The entity that submits an App for distribution via our Platform is
referred to as the "Developer," and may be the App's creator, owner,
or a third party authorized to distribute it.
We are committed to continuous improvement and innovation. Therefore,
you acknowledge that the features, appearance, or functionality of our
Services may evolve over time without prior notice.
As part of this continuing innovation, you acknowledge and agree that Onside.io may stop providing the Services (or any features within the Services), either permanently or temporarily, to you or to users generally at Onside.io’s sole discretion. For significant adverse changes or permanent discontinuation impacting core functionalities, Onside.io will endeavour to provide reasonable prior notice where commercially practicable.
You are free to stop using our Services at any time, and there is no
obligation to inform us when you do so.
The software provided for accessing our Services may occasionally
download and install updates automatically. These updates are designed
to fix bugs, enhance features, introduce new modules, or deliver full
new versions. By using our Services, you consent to receive such
updates.
Please be aware that if Onside.io disables your account access, you may
lose the ability to use the Services or retrieve your account
information, files, or any other associated content.
At present, there are no fixed limits on the number of transmissions or
the amount of storage available through our Services. However, Onside.io
reserves the right to impose such limits at any time.
5. Account Security and Password Management
You are responsible for safeguarding the confidentiality of the password
linked to your account on Onside.io.
You agree to be solely accountable for all activities carried out under
your account credentials.
If you detect any unauthorized access or misuse of your account or
password, you must promptly notify our support team at
support@onside.io .
6. Purchases of Apps and In-App Content
Some Apps available via Onside.io offer additional digital goods or
features for use within the App itself ("In-App Products"). Developers
independently determine whether Apps and In-App Products are offered
free of charge or for a fee. Prices and availability are subject to
change at any time prior to final purchase.
When you purchase an App or In-App Product, you form a direct sales
contract either with:
- Onside.io, or
- Developer (where Onside.io acts solely as a commercial agent on the Developer's behalf, and assumes no liability for payment processing or product delivery).
The identity of the seller (whether Onside.io or the Developer) will be
clearly disclosed to you on the relevant product page or during the
checkout process prior to the completion of your purchase of each App or
In-App Product.
Upon purchasing, we encourage you to promptly download or access your
App or In-App Product. If you encounter issues downloading or accessing
your purchase, please reach out to our customer support team for
assistance.
Once an App or In-App Product is successfully downloaded or accessed,
the risk of loss transfers to you, and Onside.io is not liable for
damages arising from device malfunctions or similar issues.
You are responsible for paying any taxes related to your purchases
(except corporate income tax), and all prices will include VAT where
applicable unless stated otherwise.
If legally required, Onside.io may collect and remit taxes on your
behalf.
Refunds and Consumer Rights
All sales made through Onside.io are considered final.
As a consumer in the EU, you generally have a statutory right to
withdraw from digital content purchases within 14 days. However, by
agreeing to immediate delivery of the digital content, you expressly
waive this right of withdrawal.
If you detect unauthorized purchases, made via Onside.io's App Store, on
your card or payment method, please contact contact@onside.io to
request a refund.
In the event a refund is granted, you will lose access to the
corresponding App or In-App Product.
Developer End-User License Agreements (EULA)
Developers may provide their own End-User License Agreement ("Developer
EULA") to govern the use of their Apps.
For the avoidance of doubt, Onside.io is not a party to any Developer
EULA executed between you and the Developer. Onside.io assumes no
responsibility or liability for compliance with, or breaches of, any
Developer EULA. If no Developer EULA is provided, the following Standard
EULA applies:
- The Developer is the App's licensor.
- Unless otherwise stated, you are granted a personal, limited, non-transferable license to download and use the App for private, non-commercial purposes.
- You may not alter, reverse-engineer, decompile, or disassemble the App, nor create derivative works based on it, unless the Developer provides explicit written permission.
- Intellectual property rights associated with the App remain with the Developer or their licensors; the App is licensed, not sold.
If there is a conflict between a Developer's EULA and the Standard EULA, the terms of the Standard EULA will prevail to the extent of any inconsistency.
7. Your Use of the Services
You agree to use the Services provided by Onside.io only for purposes
that comply with these Terms, as well as with all applicable laws,
regulations, and accepted standards in your jurisdiction. This includes
all content you submit, such as app reviews or ratings.
If you intend to upload or distribute apps or other materials through
the Services, you must first enter into a distribution agreement with
Onside.io.
You also commit not to engage in activities that could disrupt,
interfere with, or compromise the Services, servers, or networks
associated with Onside.io.
Unless a separate, written agreement grants you permission, you are
prohibited from copying, selling, trading, or otherwise exploiting any
portion of the Services.
You may only access the Services through official interfaces provided by
Onside.io. Automated means — such as scripts, bots, or crawlers — are
not allowed unless expressly permitted, and you must respect any
instructions listed in the Services' robots.txt file.
You are solely responsible for any breaches of these Terms and any
resulting harm or liability to Onside.io.
8. Acceptable Use Guidelines
Onside.io reserves the right, at its sole discretion, to approve,
reject, or remove any app submitted for distribution, without needing
approval from any third party. Even if an app meets distribution
policies, it may be restricted from certain regions where local laws or
cultural norms prohibit its availability.
If an app becomes problematic, illegal, or inconsistent with these
Terms, its distribution may be suspended or revoked.
When using the Services, you agree not to upload or share any apps or
content that are illegal, harmful, deceptive, infringing, or otherwise
objectionable. In particular, your content must not:
- Contain or promote sexually explicit material, pornography, or profanity unless within the EU laws and regulations and after being approved explicitly through Onside.io's review procedures.
- Sexualize minors or facilitate inappropriate interactions with minors.
- Advocate violence or hatred against individuals or groups based on race, ethnicity, religion, disability, age, nationality, veteran status, gender, or sexual orientation.
- Endorse terrorism or portray gratuitous violence (fictional violence, such as in games, may generally be acceptable).
- Facilitate the sale of weapons, explosives, or hazardous materials.
- Promote illegal drug use, irresponsible alcohol or tobacco consumption.
- Offer deceptive financial services.
- Enable online gambling without adhering to local regulations and Onside.io's specific review procedures.
- Support illegal activity or violate intellectual property rights.
- Breach privacy laws, such as GDPR.
Additionally, you must not distribute apps or materials that:
- Contain malware, including viruses, spyware, ransomware, or other malicious software.
- Damage user devices or compromise personal information.
- Create excessive network strain or generate unexpected costs for users.
- Violate the terms of service of authorized carriers.
- Provide a misleading, spam-like, or otherwise poor user experience.
Onside.io reserves the right to remove or restrict access to any content that violates these Terms, without prior notification. It may also report suspected illegal activity to the appropriate authorities and cooperate with investigations by providing relevant user information.
9. Content Available Through the Services
You understand that any content — whether data, text, software, music,
images, video, or otherwise — that you access through the Services is
the sole responsibility of the source providing it.
Certain materials, including apps, sponsored content, or advertisements,
may be protected under intellectual property laws and belong to
third-party creators, developers, or sponsors. Unless specifically
authorized by Onside.io or the content owner, you may not alter, lease,
sell, or create derivative works based on this material.
Although Onside.io may, at its discretion, monitor, review, or remove
content, it is under no obligation to do so.
Tools may be offered to help you filter sensitive content, such as adult
content settings, or you may use third-party solutions to manage
unwanted material.
By using the Services, you acknowledge the risk of encountering content
that you may find inappropriate or offensive.
You bear full responsibility for the content you create, upload, or
share through the Services and for any consequences that result.
If you believe your rights — or the rights of someone else — have been
infringed by content hosted by Onside.io on behalf of a user, you may
submit a report.
How to Submit a DMCA Notice:
If you are the copyright holder or authorized to act on behalf of one,
you can submit a DMCA takedown notice containing:
- Identification of the copyrighted work allegedly infringed (or a list of works).
- Details about the material or links in question, including a URL or precise location.
- Your contact information, including name, address, telephone number, and, if available, email.
- A statement under penalty of perjury affirming that you have a good faith belief that the use is unauthorized.
- A statement confirming the accuracy of your claim and your authorization to act on behalf of the rights holder.

Onside.io reserves the right to disable or terminate user accounts belonging to repeat infringers and may pursue other remedies as permitted by law.
10. Personal Information
To access certain functionalities within the Services, you may be asked
to provide personal details such as identification or contact
information. This information may be collected during the registration
process or as part of your continued use of the Services.
You agree that all personal data you submit will be truthful, accurate,
and kept current.
For further information about how your personal information is
collected, processed, and stored, please consult our Privacy
Policy.
You also acknowledge that Onside.io may collect, process, and retain
your personal data as necessary for delivering the Services to you.
11. Ownership and Intellectual Property
You acknowledge and agree that Onside.io (or its licensors) holds full
legal rights, ownership, and intellectual property interests related to
the Services, regardless of whether such rights are registered globally.
You understand that certain information provided within the Services may
be considered confidential, and you agree not to disclose any
confidential material without prior written consent from Onside.io.
Unless specifically authorized in writing, these Terms do not grant you
any rights to use Onside.io's trademarks, trade names, service marks,
logos, domain names, or other branding elements.
If you have received written authorization to use such brand elements,
your usage must strictly comply with the terms outlined in that
agreement.
Similarly, except for the limited rights granted under these Terms,
Onside.io acknowledges that it acquires no ownership over the content
you upload, submit, or display through the Services. You are solely
responsible for protecting your intellectual property rights, and
Onside.io is not obligated to do so on your behalf.
You agree not to remove, obscure, or alter any notices relating to
intellectual property rights that may be displayed within the Services.
Furthermore, unless explicitly permitted, you may not use the trademarks
or brand identifiers of other parties in ways that could mislead users
about their ownership or association.
12. License Granted by Onside.io
Onside.io grants you a personal, non-exclusive, non-transferable,
royalty-free, worldwide license to use the software provided to you as
part of the Services ("Software"), strictly for the purpose of
utilizing the Services as outlined in these Terms.
You agree not to copy, modify, create derivative works,
reverse-engineer, decompile, or attempt to extract the Software's source
code, except where explicitly allowed under applicable law, under an
open-source license, or with express written permission from Onside.io .
You may not sublicense, transfer, or otherwise assign your rights to the
Software without prior written consent from Onside.io.
13. License You Grant to Onside.io
By submitting, posting or displaying the content you give Onside.io a
perpetual, irrevocable, worldwide, royalty-free, and non-exclusive
license to reproduce, adapt, modify, translate, publish, publicly
perform, publicly display and distribute any Content which you submit,
post or display on or through, the Services, solely for the purpose of
enabling Onside.io to display, distribute, promote, operate, and improve
the Services and make such Content available to end-users.
This license includes the right to share your content with partners,
affiliates, or third-party service providers, and to make necessary
technical adaptations to ensure compatibility across various devices,
services, and networks.
You represent and warrant that you have all the rights necessary to
grant this license to Onside.io.
You retain ownership and responsibility over the content you upload,
submit, or display using the Services.
14. Termination of Relationship
These Terms remain in effect until either you or Onside.io terminates
the agreement.
You may end your relationship with Onside.io at any time by providing
written notice via support@onside.io and closing your accounts linked
to the Services.
Onside.io may terminate its agreement with you if:
- You breach any provision of these Terms.
- Legal requirements or regulations necessitate termination.
- A third-party partner ceases offering Services involving Onside.io.
- Onside.io decides to discontinue providing Services in your country.
- Continuing to provide the Services is deemed commercially unfeasible.
Any rights, obligations, or liabilities that are intended to survive termination will remain in effect even after the agreement ends.
15. Disclaimer of Warranties
Nothing in these Terms excludes or limits liability where such exclusion
is prohibited by law.
Some jurisdictions do not allow limitations on implied warranties or
certain liabilities, so in those cases, only lawful limits will apply.
You expressly acknowledge that your use of the Services is at your sole
risk. The Services are provided on an "as is" and "as available" basis.
Onside.io, its subsidiaries, affiliates, and licensors do not warrant
that:
- The Services will meet your expectations.
- The Services will be uninterrupted, timely, secure, or error-free.
- Information obtained through the Services will be reliable or accurate.
- Any defects in the software or Services will be corrected.
Any material downloaded or otherwise accessed through the Services is
done at your discretion, and you are solely responsible for any
resulting damage or loss of data.
No oral or written advice obtained from Onside.io shall create any
additional warranty beyond those expressly stated here.
Onside.io expressly disclaims all implied warranties, including
warranties of merchantability, fitness for a particular purpose, and
non-infringement.
16. Limitation of Liability
To the maximum extent permitted by law, Onside.io, along with its
subsidiaries, affiliates, and licensors, shall not be liable for:
- Any indirect, incidental, special, consequential, or exemplary damages.
- Loss of profits, goodwill, business reputation, or data.
- Costs of procurement for substitute products or services.
- Any loss or damage resulting from reliance on advertising or third-party services.
- Any changes to the Services, including suspension or discontinuation.
- Deletion, corruption, or failure to store any content or data maintained through your use of the Services.
- Failures related to inaccurate account information or breaches of account security.
These limitations apply whether or not Onside.io has been advised of the possibility of such losses.
17. Advertising
The Services may be supported by advertising revenues and may display
advertisements or promotions, which could be targeted based on content,
searches, or other usage information.
For details on advertising practices, please refer to our Privacy
Policy.
Onside.io may modify the form, style, or frequency of advertisements
without prior notice.
18. Third-Party Content
The Services may include links to external websites, services, or
resources that are not operated by Onside.io.
You acknowledge that Onside.io has no control over such external content
and is not responsible for their availability or content.
You agree that Onside.io shall not be liable for any loss or damage
resulting from your reliance on any external sites, services, or
resources.
19. General Legal Terms
In some cases, you may use services, software, or goods provided by
third parties while using the Services. Separate agreements between you
and those third parties may apply, and these Terms do not alter such
relationships.
These Terms constitute the complete legal agreement between you and
Onside.io regarding the use of the Services, replacing any prior
arrangements.
Onside.io may communicate with you via email, postal mail, or
notifications within the Services.
If Onside.io does not enforce a right immediately, it does not mean it
has waived that right.
If any part of these Terms is found invalid by a court, the remainder
will still be fully enforceable.
Onside.io's affiliates may enforce provisions of these Terms that
benefit them. No other third parties shall have rights under these
Terms.
These Terms are governed by the laws of The Netherlands, and disputes
will be subject to the exclusive jurisdiction of the courts in
Amsterdam, The Netherlands.
